Nebraska: GOP Senate Candidate Glad To See SCOTUS Reconsider Partial-Birth Abortion Case Bearing His Name

Republican U.S. Senate candidate Don Stenberg said he is pleased the U.S. Supreme Court has agreed to reconsider the 2000 partial-birth abortion case that bears his name from his time as Nebraska Attorney General.

Prior to Stenberg v. Carhart, 20 states, including Nebraska, had outlawed the practice of partial birth abortions.

The Supreme Court at that time gave two reasons Nebraska’s ban was unconstitutional: that it could be interpreted to prohibit abortions - other than partial birth abortions - and that there was no health exception for the mother.

Stenberg said with the recent Supreme Court appointments, the decision could be overruled.

“If my prediction proves to be correct, it will underscore the enormous importance of the appointment and confirmation of justices to the U.S. Supreme Court who will respect the Constitution and not legislate from the bench,” he said.

The candidate was in Columbus on Friday and spoke on several other issues facing the country.

He said he is a conservative Republican who would reflect the majority view in Nebraska. He said the war on terror needs to continue and that he supports President Bush’s aggressive approach.
